when allegations of rape are supported by evidence from well-respected medical and psychological experts who unanimously confirm not only that systematic abuse has taken place, but go so far as to name two of the most likely perpetrators, you, as representative of the Crown Office, believe it right to dismiss their testimony and allow those named to leave the country;

when a school doctor twice reports an under-age girl to be at risk, and that girl’s headmaster - one of those subsequently named as a serial rapist - consistently fails to alert the child’s mother or to take any steps to protect her, you, as representative of the Crown Office, believe this to be the normal behaviour of a responsible, and guiltless, person;

when a case of rape is reported by a girl with speech difficulties, you, as representative of the Crown Office, do not believe it is necessary to supply her with support during police interviews, but are happy to use her handicap, in this respect, to discredit her spoken evidence;

when a case of repeated multiple gang rape over many years is reported by a young girl who also names seven fellow victims, you, as representative of the Crown Office, do not believe that, in view of the Scottish law regarding corroboration, it is absolutely essential that the police question those she has named immediately.

When an acknowledged victim of rape receives a substantial award from the Criminal Injuries Compensation Authority, you, as representative of the Crown Office, feel justified in continuing to maintain that the allegations on which this award was based were fully investigated and found to be false.
The document produced by the Police Complaints Commission for Scotland included the lines. "The position, as far as I can determine it, is that there seems a sufficiency of evidence to accept, on the balance of probability, that X was sexually abused, and that this has included penetration of her private parts. Given that X, because of her disabilities, has been closely supervised throughout her life, the perpetrator is most likely to have been someone close to her who had regular, unsupervised access.”
Re Alex Salmond's non-compliance with the Information Commissioner until threatened with criminal proceedings: in Scotland's only independent law magazine, The Firm, 11 July 2011, we read: 'Last month the Scottish Ministers were compelled by the Information Commissioner to address a series of questions put to the First Minister in correspondence in relation to the (Hollie Greig) case in January this year, the first of which was: “When did you first become aware of the allegations made by Hollie Greig about her being abused by members of a high-ranking paedophile ring in Scotland?” The commissioner required the Scottish Ministers to respond by today’s date or risk being held in contempt of court.' A letter to Robert Green from the Information Commissioner dated 10 April 2014 states: 'I am writing in response to your letter of 6 April 2014 ... in which you asked for the date on which the Commissioner issued the decision referenced in the Firm Magazine's articles. The Commissioner's decision was issued on 26 May 2011.' It was not until they were under threat of criminal proceedings that the First Minister's Office came up with an answer, saying it was impossible to give a date, since all the relevant records had been lost. However, the magazine goes on to say, 'The Firm has seen correspondence from the Crown Office dated 23 July 2009 addressed to the Greig family’s lay representative Robert Green, which suggests that correspondence addressed to the First Minister outlining the allegations was received over two years ago.' Re the likely validity of Hollie Greig's claims, The Firm writes, 'Greig received a payout of £13,500 from the criminal injuries compensation authority, and was described by Detective Inspector Iain Allen of Grampian Police as “a truthful witness to the best of her ability and an entirely innocent victim.” ' Ample expert witness statements from respected police and medical professionals, including Hollie's school doctor, back up her allegations. Of 22 persons named by Hollie as abusers, only two (her father and her brother) have ever been even superficially questioned by the police. Even though her father and brother were described in a police report as having 'a predilection for very young girls', they were allowed to go abroad to Portugal, where they run a business connected called 'Daisy Chain' which involves frequent travel to and from South America. The implication of the Crown Office's claim that 'a thorough investigation has taken place' is, therefore, that a thorough investigation does not require those accused by an acknowledged victim to be interrogated, nor does it require their computers to be seized or their homes searched before despoliation of evidence occurs.

The farce came as police probe incredible claims that the former prime minister was linked to a paedophile ring that killed as many as 16 children – which would make them the worst child murderers in British history.
The seemingly far-fetched allegations have been made by a family who allege that the politician was part of a satanic sex cult run by their own parents.

They claim their mother and father – who is said to have known the former Conservative leader – were responsible for slaughtering children ranging from babies to teenagers – yet they evaded justice.
The paedophile ring – which they say Sir Edward was part of – stabbed, tortured and maimed youngsters in churches and burnt babies in satanic orgies before men, women and children gorged themselves on blood and body parts, police have been told.

But there is no suggestion that Sir Edward killed any children himself in the women’s accounts
If the bizarre allegations were to be proved, the parents who allegedly led the killings would be responsible for murdering more children than Fred and Rose West.
They would also be on a par with Thomas Hamilton, who shot dead 16 children in the 1996 Dunblane school massacre.
The women’s lurid claims were dismissed by police in 1989 when they came forward. Sir Edward’s name was never mentioned to police at the time. It was only last year that he was named for the first time after one of the claimants said she had ‘remembered’ a man called ‘Ed’ was a prime mover in a network of paedophile abusers.
But there is no suggestion that Sir Edward killed any children himself in the women’s accounts.
Wiltshire Police have spent more than a year investigating the allegations as part of an inquiry that has cost taxpayers over £883,431 and irretrievably tarnished the reputation of the unmarried politician, who died in 2005, aged 89.
Last night Sir Edward’s godson, Lincoln Seligman, said: ‘I understand that these claims from the 1980s were at the time dismissed as complete fantasy by police. It is disappointing that these wild allegations have been reheated and randomly attached to Edward Heath’s name.’
A Wiltshire Police spokesman said: ‘We are not prepared to discuss this as this is an on-going investigation.’

GODSON HITS OUT AT CHIEF'S CLAIM

The godson of Sir Edward Heath reacted angrily yesterday after it was claimed that a police chief is ‘120 per cent’ sure that sex abuse allegations against the former prime minister are genuine.
Wiltshire Chief Constable Mike Veale was reported to believe child abuse allegations against the late politician – which include lurid tales of satanic child slaughter – are ‘totally convincing’.
Mr Veale, whose force has been investigating the claims for 18 months, is also said to believe that Sir Edward was a paedophile whose crimes were covered up.
Police have established that, contrary to claims that Sir Edward could not have committed the crimes because he never drove a car and always had a police driver with him, he did drive and once had a car.
But the claims have infuriated Sir Edward’s godson, who dismissed it as a ‘PR hustle of some sort’ by the Wiltshire force ahead of an official report into the investigation. Lincoln Seligman, who has described the probe as a ‘witch-hunt’, has questioned how police can say the allegations are true, just on the basis that he may have driven a car.
Yesterday Mr Veale said: ‘The legal role of the police service is to, on behalf of the public, impartially investigate allegations without fear or favour, and go where the evidence takes us.’

The Royal Commission into Institutional Responses to Child Sexual Abuse in Australia has issued its report following the examination of allegations of child sexual abuse of a number of former students at two performing arts institutions in Sydney:-
  • the Australian Institute of Music (AIM)
  • RG Dance Pty Limited (RG Dance)
Performing arts institutions such as AIM and RG Dance are not typical of the organisations that we commonly associate with allegations of child sexual abuse. What is most striking about this report is the reaction and/or inaction of some parents and other responsible adults in the face of these allegations, when the abuse was in plain sight.
In the case of AIM, Victor Makarov a renowned Ukrainian pianist, was appointed head of the piano department in 1998 and taught there until 2004. Between mid-February and May 2004 Makarov was charged with 30 child sexual offences. He continued to teach at AIM under supervision and with restriction, despite the fact that in April 2004, the NSW Department of Education advised AIM that Makarov was considered a ‘high level of risk’. Makarov was never suspended by AIM and remained in post until he sought leave from AIM in July, 2004, which was granted.
On the 30 March 2004 the New South Wales Ombudsman served an investigation notice on AIM notifying its intention to investigate AIM’s handling of and response to the allegations of child abuse. In the course of this investigation, it was discovered that despite having been charged with 30 child sexual offences Makarov was teaching students in his home, these students’ parents had taken their children out of AIM so that they could be taught by Makarov at home. Makarov was eventually convicted for child sex offences and subsequently jailed.
Grant Davies was a dance teacher and co-founder of RG Dance. Police began investigating him after his wife found child pornography material and messages on his laptop. In 2013 he was charged with 63 child sexual offences relating to various acts of child sexual abuse committed over a period of 13 years between 2001 and 2013. His victims were aged between nine and 14. Davies pleaded guilty to a large number of child sex abuse charges and in 2015 was sentenced to a maximum term of 24 years’ imprisonment, with a non-parole period of 18 years.
Davies used his position as a dance teacher to groom students and commit child sexual abuse offences.  He talked with them online late into the night. He entered changing rooms unannounced, inappropriately touched students and made sexualised comments to them. In 2007 complaints of child sexual abuse offences were made against Davies to the police by a number of RG Dance students.  Although NSW Police investigated the allegations, the matter did not proceed to a prosecution.
Many of these acts occurred in public places within RG Dance and were witnessed by parents, teachers, administrators and students. The parents of the children had a strong wish for their child to succeed at dance and many believed Davies when he promised he would turn their daughters into stars. Davies was also able to groom the parents to comply with his wishes. The students, who wanted to succeed, felt emotionally blackmailed and intimidated by Davies. Both parents and students feared that if they did not comply with Davies’ requests that this would negatively impact their dance careers and their opportunity to be a star. As a result abuse was not reported when it should have been, thus enabling Davies to abuse children over such a long period of time, which is particularly worrying when you consider that this abuse is not historical in nature, it is very recent having taken place as late as 2013.
However, with recent revelations of similar abuse in football in the last few months, what is now clear is how vigilant we as a society must be when it comes to the steps that must be taken to protect children in the very many circumstances where they come into regular contact with adults in their daily lives.
Today in the majority of situations where adults work and/or interact with children there are established child protection/safeguarding policies or codes of conduct in place and the necessary procedures and systems required to prevent, handle and receive complaints of allegations of child sexual abuse are embedded in those organisations.
Of course for those policies and procedures to be effective, people need to be aware of their existence, trained in how to apply them and know how and when to activate the procedures so that abuse in plain sight does not go unreported.

Scottish Limitation Abolition Bill

Having received 15 written responses to its call for evidence on the Bill to abolish limitation in cases of childhood abuse, the Justice Committee of the Scottish Parliament will hear its first oral evidence on the Bill when it meets tomorrow (Tuesday 21 February 2017).
That evidence is scheduled to be given on behalf of: APIL (the Association of Personal Injury Lawyers); FBGAQH (Former Boys and Girls Abused in Quarriers Homes); Rape Crisis Scotland; Victim Support Scotland; ABI (Association of British Insurers) and FOIL (Forum of Insurance Lawyers).
